1. Agreement
These terms govern your use of Lookback, operated by MyEVM, Inc., a corporation organized under the laws of Wyoming ("we", "us"). By creating an account you agree to them. If you do not agree, do not use the service.
You must be at least 18 years old to use Lookback.
2. What Lookback is
Lookback is a personal record-keeping tool. It stores dated entries you write, files you attach, and reports generated from that material.
What Lookback is not. It is not legal, medical, financial, or professional advice, and it is not a substitute for any of those. The reports it generates are produced by an AI model working from the text you supply. They may contain errors, omit relevant material, or characterize events inaccurately. Do not rely on a report as a factual finding, a legal document, or a substitute for the underlying record. Verify anything that matters before acting on it or presenting it to anyone.
We make no representation that material stored in Lookback will be admissible in any proceeding, will satisfy any evidentiary standard, or will be accepted by any court, agency, employer, or insurer.
3. Your account
You are responsible for the security of the Google account you use to sign in and for all activity under your account. Notify us promptly if you believe your account has been compromised.
One account per person. Do not share credentials.
4. Your content
You own what you write. We claim no ownership of your entries, uploads, or reports.
You grant us a limited license to store, process, transmit, and display your content solely to operate the service for you — including transmitting entry text to our AI provider when you request a report. This license exists only so that the service can function and ends when you delete the content or your account.
You are responsible for what you record. By using Lookback you confirm that you have the right to store the content you upload and that doing so does not violate the law or anyone else's rights. In particular, do not use Lookback to store:
- Content that is illegal, or that you obtained illegally
- Recordings made without a consent legally required in your jurisdiction
- Another person's confidential, medical, or financial records without authorization
- Material that sexually exploits or endangers a minor
- Content whose purpose is to harass, stalk, threaten, or defame
- Malware, or anything designed to compromise systems
We may suspend or terminate an account that violates this section. We do not proactively monitor content, and are not obligated to review it.
5. Subscription and billing
Lookback costs $25.00 per month, billed in advance through Stripe.
Renewal. Your subscription renews automatically each month until cancelled. You authorize us to charge your payment method on each renewal date.
Cancellation. You may cancel at any time from Settings. Cancellation takes effect at the end of the current billing period — you keep access until then, and are not charged again.
Refunds. Payments are non-refundable, including partial months. We may issue a refund at our discretion, such as where a technical failure prevented you from using the service.
Failed payments. If a charge fails, we may retry it and may suspend access until payment succeeds. Content is retained during suspension in accordance with our Privacy Policy.
Price changes. We may change the price with at least 30 days' notice by email. The new price applies from your next renewal. If you don't accept it, cancel before that date.
Usage limits. Report generation is limited to 20 reports per calendar month per account. Entries, threads, and storage are not metered, subject to the fair use provision below.
6. Fair use
Lookback is priced for individual personal use. We may contact you, and where necessary limit or suspend an account, if usage is so far outside normal individual patterns that it materially degrades the service or imposes disproportionate cost — for example automated bulk uploading, or use as general-purpose file storage unrelated to record-keeping.
7. Availability
We aim to keep Lookback available and working, but we do not guarantee uninterrupted service. We may modify, suspend, or discontinue features. If we discontinue the service entirely, we will give at least 30 days' notice and a means to export your content.
Keep your own copies. Settings includes an export function. For anything you would be seriously harmed by losing, export regularly and store the file somewhere you control. We maintain backups but do not guarantee recovery of any particular data.
8. Termination
You may stop using Lookback and delete your account at any time.
We may suspend or terminate your account if you breach these terms, if required by law, or if your account is used in a way that creates legal risk or harm to others. Where circumstances allow, we will give notice and an opportunity to export your content.
Data handling after termination is described in the Privacy Policy.
9. Disclaimers
The service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty as to the accuracy, completeness, or reliability of AI-generated reports.
10. Limitation of liability
To the maximum extent permitted by law, MyEVM, Inc. and its officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or lost opportunity, arising out of your use of the service — including any outcome of a proceeding, claim, employment decision, or dispute in which your Lookback records were or were not used.
Our total aggregate liability for any claim relating to the service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
11. Indemnity
You agree to indemnify and hold harmless MyEVM, Inc. from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the service, or your breach of these terms.
12. Changes to these terms
We may update these terms. For material changes we will give notice by email at least 30 days before they take effect. Continued use after that date constitutes acceptance. If you don't accept, cancel before the change takes effect.
13. Governing law
These terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in Sheridan County, Wyoming, and you consent to their jurisdiction.
14. Arbitration and class action waiver
Please read this section carefully. It affects how disputes between us are resolved.
Informal resolution first. Before starting a formal proceeding, you agree to contact us at yo@myevm.org and give us 30 days to try to resolve the matter. Most disputes can be settled this way.
Binding arbitration. If we cannot resolve it informally, you and MyEVM, Inc. agree that any dispute arising out of or relating to these terms or the service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in Wyoming, or by telephone or video, or in your home county if you prefer. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.
Class action waiver. You and MyEVM, Inc. agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative action. The arbitrator may not consolidate claims or preside over any form of representative proceeding.
Exceptions. Either party may bring an individual claim in small claims court. Either party may seek injunctive relief in court to protect intellectual property rights. Nothing here prevents you from filing a complaint with a government agency.
Opting out. You may opt out of this arbitration agreement by emailing yo@myevm.org within 30 days of first accepting these terms, stating your name and that you are opting out of arbitration. Opting out does not affect any other part of these terms, and we will not treat you differently for doing so.
If the class action waiver is found unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies to all other claims.
15. General
These terms and the Privacy Policy are the entire agreement between us. If any provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets.
